The "What Tribe Are You? Win a Trip" Sweepstakes" Sweepstakes ("Sweepstakes") will begin at 12:00 a.m. Eastern Daylight Time ("EDT") on October 1, 2012 and end at 11:59:59 p.m. EDT on December 31, 2012 ("Promotion Period"). Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to these Official Rules, and Sponsor's and Administrator's decisions, which are final and binding in all matters related to the Sweepstakes. The Sweepstakes is sponsored by Myriad Marketing, 1334 Parkview Avenue, Suite 300, Manhattan Beach, CA 90266 ("Sponsor"). The Sponsor is responsible for all aspects of this Sweepstakes.
Eligibility: The Sweepstakes is open only and offered only to legal residents of the 50 United States and Washington, D.C. ("U.S.") and Canada (excluding Quebec), who have reached the age of majority in his or her state or province of residence at the time of entry of residence at the time of entry. Employees, officers and directors of Sponsor, Myriad Marketing, American Sweepstakes & Promotion Co. (the "Administrator"), their respective parents, affiliates, subsidiaries, divisions, advertising, promotional, fulfillment and marketing agencies (collectively, including the Sponsor, "Released Parties"), their immediate families (including parents, children - whether step children or adoptive children or biological children, siblings, spouses and in-laws) and persons living in the same household (whether related or not) are not eligible to participate in the Sweepstakes. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and where prohibited, or restricted by law, rule or regulation.
How to Enter: Enter online by visiting www.WhatTribeAreYou.com ("Website"). The information that will be requested upon registration is as follows: name, complete mailing address (NO PO Boxes), daytime phone number, valid email address and answer a short quiz. All entries must be received by 11:59pm EST on December 31, 2012. Limit one entry per person/household/per email address. Sponsor reserves the right to disqualify any person or email address that submits more than one entry regardless of entry method. Incomplete entries, or those containing incorrect information, will be voided. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification of all such entries as well as the entrant. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor which is final and binding in all matters relating to the Sweepstakes. All required information must be provided to enter and to be eligible to win. Incomplete entries will be disqualified. Proof of entering information at the Website is not considered proof of delivery to or receipt by Sponsor of an entry. Entries must be made by the entrant only at the Website. Entries made by any other individual or any entity, and/or originating at any other website or e-mail address will be declared invalid and disqualified for this Sweepstakes. All travel arrangements are subject to availability, blackout dates & other restrictions. Reservations must be confirmed at least (90) days prior to intended date of departure and are subject to availability at time of request. Prize travel must be completed by 12/31/2013.Winner & guest must travel on same itinerary throughout. Rebooking and changes are not permitted. Tickets are non-refundable and non-transferable. All unspecified expenses related to acceptance/use of prize & all taxes on prize are winner's sole responsibility. For Grand Prize, expenses not covered by Myriad Marketing/PNG Tourism include costs of obtaining required travel documents (including Australian & PNG visa's and passport), insurance, immunizations and other medical costs (winner is advised to consult with physician or other medical professional and obtain necessary immunizations at least 4-6 weeks prior to travel). No prize substitution, except by Sponsor, in its sole discretion, if advertised prize is unavailable and only then for prize of equal or greater value. No prize transfer. Myriad Marketing/PNG Tourism shall not be held responsible for travel delays. Prize winner will be accommodated where possible. The Sponsor reserves the right at its sole discretion to substitute the prize with another prize of equal or greater value in the event that the aforementioned prize is not available. Odds of winning depend on the number of eligible entries received during the Promotion Period. By accepting either of the aforementioned prizes, the Grand Prize winner agree to release the Released Parties from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the Sweepstakes or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded, or while preparing for, participating in, and/or traveling to and from any prize-related activity.
Drawing and Notification: The Grand Prize winner will be selected from among all eligible entries received, in a random drawing by the Administrator, an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. The drawing will be completed on or about January 10, 2013. Odds of winning will depend on the total number of eligible entries received. Winner will be notified by telephone. Upon initial notification and verification of potential winner by phone, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of Sponsor's choice. The Grand Prize winner is responsible for all applicable federal, state and local taxes and/or any other fees/costs associated with the prize or receipt of the prize. In the event of noncompliance with the Official Rules, if a potential winner cannot be reached at the address/phone number on winner's entry or if the prize or prize notification is returned as unclaimed or undeliverable, an alternate winner will be selected. The winner's entry and acceptance of the prize constitutes permission (except where prohibited) for the Sponsor to use said winner's name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
Prize Conditions: The Grand Prize winner is solely responsible for all applicable federal, state and local taxes and/or any other fees/costs associated with the prize or receipt of the prize. If a Canadian citizen wins the Grand Prize, they will be required to answer, unaided, a mathematical skill-testing question. The winner will be required to sign and return an Affidavit of Eligibility and Liability / Publicity Release (unless prohibited) within 14 days of written notification or prize winner will be disqualified. The winner's travel companion must also execute and return a Travel Companion Waiver. If the travel companion is a minor, parent or legal guardian must sign and return release and accompany minor on trip. In the event of noncompliance with the Official Rules, if a winner cannot be reached at the address/phone number on winner's entry within 5 days of the first attempt, or if the prize or prize notification is returned as unclaimed or undeliverable, an alternate winner will be selected. The prize will be only awarded to a verified winner. The winner's entry and acceptance of the prize constitutes permission (except where prohibited) for the Sponsor to use said winner's name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
Other Terms & Conditions: The Sweepstakes is subject to all applicable federal, state, and local laws. A tax Form 1099 may be issued to the Grand Prize winner for the ARV of the prize awarded. By participating in the Sweepstakes, entrants and travel companions selected by the Grand Prize winner agree to be bound by these Official Rules and agree that: 1.) Released Parties and their designees and assigns shall have the right and permission to use (unless prohibited by law) the winner's and travel companions' names, photographs, likenesses, statements, biographical information, voices and addresses (city and state), in all forms of media, in perpetuity, without further notice, permission or compensation, and 2.) DISPUTES: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California.
